A proposal for an amendment to the Constitution

Given the importance of the recognition of a Zionist Federation by the World Zionist Organization, according to the Zionist Executive proposal,

and in light of the fact that recognition of a new Zionist Federation has a Zionist and Jewish significance,

be it resolved to add to Article 11, the following words (bolded and underlined):

Article 11

"The Council may, when in session, upon the proposal of the Executive, decide, by a two-thirds' majority of its members entitled to vote, to admit as Member of the World Zionist Organization a Zionist Territorial Organization which has recognized the Zionist Programme as set out in Article 2, but has not fulfilled all the requirements indicated in the foregoing Article."

In order to ensure equal conditions for each organization and to make certain that every person who is a member of the World Zionist Organization will have only one vote, according to Article 25 Section 1;

be it resolved that Article 9, Section 2 of the Constitution will be canceled and replacing it will be the following Section:

Article 9, Section 2:

"A Women's Zionist Organization cannot in any instance be affiliated to another body that is a member of the National Zionist Organization. Furthermore, the executive members of a Women's Zionist Organization, whose representation is guaranteed by the fact of its being a Women's Organization, will not be able to be part of any lists that are running for the Zionist Congress Elections."

A. Whereas the Zionist General Council has decided at its XXXIII/4 meeting, that was held on Sivan 17th 5760, June 20th-23rd, 2000, Article C Section 30 - Ensuring the representation of the young - Amendment to the Constitution:

  1. The representation in the Zionist Congress and in the following Zionist General Council will include at least 25% delegates aged 18-30 from all the delegates to the Zionist Congress and the Zionist General Council.
  2. And whereas in the regulations to apply the decisions approved in the Zionist General Council XXXIII/5, held in June 2001, the issue of the Zionist General Council was omitted.
B. Be it resolved to add to Article 32 (of the Constitution) Section 1, the following line:
"25% of the members in each of the Zionist Congress parties will be from among the young generation."
In this Constitution Article, the term "member of the young generation" refers to every Jew who is a member in a body affiliated with the World Zionist Organization (Section 3), has reached 18 and is no older than 30.

In order to prevent a state of duality while establishing an Election Committee in places where there is more than a single Zionist Federation,

or alternatively, to prevent, for any reason at all, a situation whereby two Area Elections Committees are established in a place where there is but a single Zionist Federation,

be it resolved to add to Article 20 Section 2:

Furthermore, in electoral areas where there is more than a single National Zionist Organization, only one Area Elections Committee will function, drawn from all of the organizations that were represented at the last Zionist Congress.

Article 20 Section 2:

"In electoral areas (countries) in which a single Zionist Territorial Organization in operating, its Executive Committee or a body authorized by it may discharge the functions of the Area Elections Committee."

A proposal for an amendment to Article 38a of the World Zionist Organization's Constitution

If the Zionist Congress has not decided, and during the period between two Zionist Congresses the Zionist General Council, has not determined otherwise, participants on behalf of the World Zionist Organization in the Jewish Agency Board of Governors will be:

I. Members of the Zionist Executive.

II. Members recommended by the factions according to their proportional weight in the Zionist Congress.

Whereas the members of the Jewish Agency's Assembly on behalf of the World Zionist Organization are determined on the basis of the faction's weight,

be it resolved that Article 38 3a will be canceled and instead will be determined that:

When there is a need for additional members in order to achieve the number specified by the Jewish Agency's Constitution, members recommended by the factions will be appointed according to their proportional weight in the Zionist Congress.

Appendix to Section 38 a64:

"Unless otherwise determined by Congress - or in inter-Congress periods by the Zionist General Council - the following shall be members of the Assembly of the Jewish Agency on behalf of the WZO:

(i) The members of the executive;
(ii) The Chairman of the Board of Directors of the KKL;
(iii) The members of the General Council with voting rights or in their place those deputy-members who were empowered to deputize for a member in accordance with Art. 32, Section 4, 7 and 8;
(iv) Persons appointed by the Presidium of the Zionist General Council together with the Executive in so far as additional representatives on behalf of the WZO are required in order to attain the number laid down in the Constitution of the Jewish Agency. As far as possible priority shall be given to the chairmen of the Zionist Federations participating in accordance with Article 32, Section 1A in the sessions of the Council.

The New Faction

A proposal for an amendment to Article 38a of the World Zionist Organization's Constitution (an addition to the existing Section)

If the Zionist Congress has not decided, and during the period between two Zionist Congresses the Zionist General Council, has not determined otherwise, participants on behalf of the World Zionist Organization in the Jewish Agency Board of Governors will be:

I. Members of the Zionist Executive.
II. Members recommended by the factions according to their proportional weight in the Zionist Congress.

Explanations

The purpose of this amendment is to keep the original meaning of Article 38 Section a, that the Zionist Congress, and between Congresses the Zionist General Council, will determine the World Zionist Organization delegation to the Jewish Agency's Assembly and to the Board of Governors.

The World Zionist Organization Council has recently made a resolution, determining its delegates to the trustees.

In our opinion, this decision contradicts the spirit of Article 38 Section A of the World Zionist Organization Constitution that determined the delegation of the World Zionist Organization to the Jewish Agency's Assembly, and this delegation has chosen the delegation to the Board of Governors.

That is, that since the amendment to the agreement for the Jewish Agency's reconstruction accepted at the last Assembly, has moved the authority to choose the members of the Board of Governors from the Assembly to the Board of Governors.

Whereas Article 51 does not reflect judicial reality of the State of Israel:

"The judgments of any bench of the Zionist Supreme Court shall be final and not subject to any appeal."

Be it resolved that:

Any ruling of any bench of the Zionist Supreme Court would be subject to appeal in a district court of the State of Israel solely.

This amendment will apply also to Article 58 Section 3:

"The decision of the Appellate Tribunal shall be final."

In order to ensure that a vacuum will not be created at the head of the Zionist Executive in case the post of the Chairman becomes vacant for any reason whatsoever;

Be it resolved that in Article 43, Section 1:

"If during the inter-Congress period the post of the Chairman of the Executive becomes vacant for any reason whatsoever, the Zionist General Council shall, at its next session, elect a new Chairman from among the members of the Executive. Pending the election, the functions of the Chairman shall be carried out by a member of the Executive elected by them by majority vote."

The words "at its next session" will be dropped out and it will be written that: "the Council shall elect a new Chairman from among the members of the Zionist Executive."

Dropping the words "at its next session", will make it possible to elect a chairman by a fax referendum.

Furthermore, pending his election, the functions of the Chairman shall be carried out by his substitute according to Article 41A:

"Former Presidents of the World Zionist Organization and former Chairman of the Executive shall be entitled to participate in the meetings of the Executive in an advisory capacity"

In the case where one of the members of the Zionist General Council resigns, according to Article 32 Section 8, their substitute must be a resident of the same region, as specified in Article 17 Section 3.

If the substitute is not from the same region, the Presidium must approve the replacement by a 2/3 majority.

Whereas this at times makes the replacement process awkward,

Be it resolved that according to this Section, "In case a member of the Zionist General Council is replaced, a substitute from the same faction as the departing member, from any region will be appointed."

Appendix:
Article 32, Section 8:
""Representative": for the purpose of this Section is a member or deputy-member of the Council elected by Congress and affiliated with a grouping of the Council.

(i) If, in any intervals between Congresses, any grouping intends to replace a representative, it shall apply to the Presidium of the Council for confirmation of the replacement. If the Presidium is satisfied that there is an important reason for the replacement, it shall grant the application. The representative proposed as replacement shall be resident in the same region (Art. 17, Sec. 3) as the person replaced, unless the Presidium decides for important reasons, with a two-thirds' majority, to permit an exemption from this rule.

(ii) Upon confirmation of the replacement, the new member or deputy-member shall have the full rights of the person replaced. The new representative may not be replaced again in accordance with the provision of lit. (a).

(iii) Details of the procedure shall be determined by Regulations to be enacted by the Presidium of the General Council.

Article 17, Section 3:
"The number of delegates to Congress, as stated in Section 1, shall be allocated in the following proportion: Israel 38%, United States of America 29%, other countries of the Diaspora 33%."

In order to improve the efficiency of the work of the Inner Zionist Executive and to make it possible to reduce the numbers of officials in the spirit of the times,

Be it resolved to make the following changes to Article 41:

Section 1
The Zionist Congress will elect a limited Executive composed as follows:
i) The Chairman of the Executive
ii) The Treasurer, who will be the substitute for the Chairman of the Executive.
iii) Nineteen members from the factions represented at the Zionist Congress, amongst whom shall be those responsible for the Departments.
iv) Will remain unchanged.

Section 2
The Zionist Congress will elect an Extended Executive consisting of up to 35 members, including all the members of the Inner Executive. The Extended Executive will convene once a year, close to the Zionist General Council.

Section 3
The Chairman of the Zionist Executive has a duty to hold an Executive meeting at least once a fortnight. In the absence, the treasurer - as substitute will convene the Zionist Executive.

Section 41a
Will remain unchanged.

Article 5 Section 4b

In order to strengthen the Territorial Zionist Federations and enable them to act while taking into consideration the reality in their regions of action, the final section of Section 4b shall be changed, from the words:

"but Congress and, in the inter-Congress period, the Zionist General Council may, on the proposal of the Executive, decide to admit as Members of the World Zionist Organization Jewish National Bodies which are not affiliated with the Zionist Territorial Organization."
will be canceled;

"A Jewish National Body which has not joined the Zionist Territorial Organization will not be able to be admitted as a member of the World Zionist Organization"

In case the Federation refuses its admittance, a Jewish National Body may turn to the Zionist Supreme Court.

Article 5 Section 4b

In order to strengthen the Territorial Zionist Federations and enable them to make judgments based upon the reality in their regions of action, Section a Paragraph 4 will be added as follows:

Replacing:
"…but Congress and, in the Inter-Congress period, the Zionist General Council, may on the proposal of the Executive decide to admit as Members of the World Zionist Organization Jewish National Bodies which are not affiliated with the Zionist Territorial Organization."

The paragraph will be corrected as follows:
"…but Congress and, in the Inter-Congress period, the Zionist General Council, by a majority of 2/3, may, on the proposal of the Executive decide to admit as Members of the World Zionist Organization Jewish National Bodies only when they are affiliated with the Zionist Territorial Organization."

In a situation where the Federation refuses to accept it, a Jewish National Body may appeal to the Zionist Supreme Court.

"A representative of the executive of an international body will not be able to be part of any list of those running for the Zionist Congress"

This is in order to prevent a situation whereby a person represented, not through elections, as a member of an international body, is able to use this status to influence the voter due to their placement on a certain list.

Considering the fact that judicial tradition in Israel allows appeals to rulings of the courts of Organizations and non-profit bodies
Be it resolved that:

Article 24
The final section "The decision of the Zionist Supreme Court shall be final" will be canceled

And instead will be written: "A party who seeks redress following the decision of the Zionist Supreme Court, may appeal the decision of the Zionist Supreme Court to the District Court in Israel alone"

If the appellant approaches a court outside of Israel

They will be cautioned by the World Zionist Organization Attorney not to do so

If the appellant continues to refuse, they will not be able to appear on the list of candidates of a faction running for the Zionist Congress or represented therein.

Article 24
"The Zionist Supreme Court shall examine the conduct of elections in every area and shall be entitled to confirm, annul or vary the results thereof. The Court shall also examine the mode of appointment of the delegates representing Zionist Bodies (Article 26, Section 4) and Jewish National and International Bodies (Article 5, Section 4 (d) (e)) and shall be entitled to confirm, annul or vary their representation. The New Faction

A proposal for an amendment to the Constitution - An addition to Article 22

Section 3
"The right to vote and be elected is given to every person who registered no less than two years before the Zionist Congress, has signed the Jerusalem Plan and has paid the Zionist Shekel."

Explanations
We are witness to unacceptable procedures within the framework of elections to the Zionist Congress in those few places where elections are taking place.
Improper and unclear behavior is leading to many appeals to the Zionist Supreme Court and to the Central Elections Board.
In order to prevent these distortions and misinterpretation of the Regulations for elections to the Zionist Congress, be it resolved that every Federation will commit to perform a census two years before the next Congress wherein every voter will sign the Jerusalem Programme and pay the Zionist Shekel.

Article 22
Section 1: "Every Jew who has reached the age of eighteen years and who is a member of a body affiliated to the World Zionist Organization (Article 3) shall be entitled to vote in elections to Congress.
The Election Rules (Article 20) may lay down that membership in such body for a certain period prior to the opening of Congress as a pre-condition of the right to vote.
Section 2: "Save as otherwise provided for in this Constitution, every person entitled to vote in elections to Congress who has reached the age of eighteen years shall be eligible for election as delegate to Congress."

Instead of Article 21, Section 1 of the Constitution will be:

I. In the State of Israel general elections to Congress shall be held in which
every citizen of the State of Israel who has reached the age of eighteen years and who is a member in good standing of the World Zionist Organization will be entitled to vote. For this purpose a person who within the 12 months prior to the elections date has signed the Jerusalem Programme and has paid member's fees directly to the treasury of the World Zionist Organization will be deemed a member in good standing. The amount of the membership fee will be set every year by the Presidium of the Zionist General Council, and failing such fee being set, the fee will be eighteen New Israeli Shekels (NIS 18).

II. A Zionist World Union is entitled to submit a list of candidates to the Zionist Congress. The lists will be submitted to the Central Elections Board which will strike from every list any candidate who is not a member in good standing and will ensure that the list was submitted by a Zionist World Union. The Central Elections Board will publish all of the approved candidates lists at least 45 days before the election date. The voting will be for those lists of candidates published by the Central Elections Board.

III. The total of all valid votes for all lists taking part in the distribution of mandates will be divided by the number of mandates of the State of Israel to the Zionist Congress, and the resulting whole number will be "the standard".

IV. Every list taking part in the distribution of mandates will receive a number of mandates to the Zionist Congress equal to the whole number that is the result of the division of its eligible votes by "the standard".

V. The mandates remaining after the allocation of mandates according to sub- section (c) will be divided among the participating lists as follows:

  1. Every list will be set a "list standard" by dividing the number of the valid votes it received by the number of mandates it obtained according to sub-section (d) plus one.
  2. The list that received the higher "list standard", will receive another mandate; if two lists or more have the same "list standard", a lottery conducted by the Central Election Board
    will decide which one of these lists will receive the extra mandate;
  3. The distribution according to sections (1) and (2) will continue until all of the mandates are allocated, whilst the list that received the extra mandate according to section (2) will be set a new "list standard" taking into account the extra mandate;
  4. A list that did not receive more than half of all the valid votes of all lists participating in the allocation of mandates, but received half of all of the mandates, will not participate in the further distribution of mandates, and the allocation will continue between the other lists.

VI. The Zionist General Council is authorized to enact regulations for holding of elections in Israel. The Law of Elections for the Knesset and the Prime Minister [Consolidated Version] Law, 5729-1969, will apply mutatis mutandis*, to matters not provided for in the Regulations.

Article 21 - Congress Representation of Israel

"No elections to Congress shall be held in the State of Israel. The Committee for Determining the Representation shall appoint the delegates in accordance with the relative strength of the Zionist parties in the last Knesset elected prior to the opening of the Congress. A party in the Knesset, which adheres to or advocates discrimination based on origin, nationality or race, shall not be represented at Congress."

As long as the Hadassah Organization has a special status as mentioned, no delegates of the Hadassah Organization shall take part in the elections to the World Zionist Organization's institutions and shall not vote in matters of candidacy. Therefore, without prejudicing the generality of the above mentioned, these delegates shall not participate in the elections according to Article 14 (e) through (g) and Article 32 (1) and (4).

In spite of the aforementioned in this Constitution and the regulations according to it, no delegates of the Hadassah Organization will join any faction of the Zionist Congress' and the Zionist General Council factions, and will not be considered at any point as part of any faction.

The delegates of the Hadassah Organization will not be taken into consideration in the counting of Zionist Congress delegates, according to Article 17 of the Constitution.

Resolution addition section 41 to the 32nd Zionist Congress Constitution, of July 1992

Combining a WUJS delegate as the delegate of the Jewish students in the Zionist Executive

Whereas WUJS, The World Union of Jewish Students, is a Jewish-Zionist international organization,

and whereas the aforementioned is a roof body of the Jewish-Zionist student organizations in Israel and all over the World,

and Whereas The World Zionist Movement has set upon itself the goal to involve and combine forces of the young in its activities and institutions,

a WUJS delegate will be the representative of the Jewish students organizations in the Zionist Executive and an ordinary member of the Executive.

Be it resolved that:

In the 34th Zionist Congress, Section 41 will be added to the Zionist Congress Constitution, as follows:

"A delegate of WUJS, The World Union of Jewish Students, will serve as an Executive member without any responsibility for departments."

Furthermore, the addition will be valid starting with the forthcoming 34th Zionist Congress.

Resolution for the Adoption of a Contemporary Zionist Platform

Whereas the Zionist idea and the Zionist imperative have evolved over the years in response to changing circumstances in the Jewish world, and

Whereas these circumstances have changed significantly since 1968 when the platform of the Zionist movement was last revised, and

Whereas Zionism continues to come under attack both from those who reject its underlying premises (anti-Zionists) and from those who claim it has fulfilled its mandate with the securing of a Jewish state (post-Zionists), and

Whereas the Zionist vision has always included the creation of an exemplary Jewish society (chevrah l'mofet) and the development of a vibrant national culture anchored in Jewish heritage, in addition to the establishment of a secure homeland for the Jewish people, and

Whereas these challenges remain as real and as significant today as ever, and

Whereas Zionism must therefore continue to be a vital and relevant movement requiring the active participation of the entire Jewish people, and

Whereas Zionism is no less the responsibility of Jews in Israel than it is the responsibility of the Jews in the Diaspora, and

Whereas the current Zionist platform - the revised Jerusalem Program of 1968 - does not present the Zionist imperative in the broad and inclusive terms necessary to engage Jews the world over, including Israel, in the contemporary spectrum of Zionist tasks, and

Whereas the current Zionist platform does not provide sufficient direction for concrete expression of Zionist commitments,

Be it resolved that the 34th Zionist Congress adopt the following as the official platform of the World Zionist Organization, replacing the current Jerusalem Program in all respects and with all the implications thereof, ideological and legal:

The Jerusalem Program, 2002

Zionism is the collective responsibility of and for the entire Jewish people. It seeks to fashion and fortify the Jewish national home in Eretz Israel, deepen Jewish national consciousness around the world, and develop a Jewish national culture with Israel at its center. Accordingly, the Zionist Congress calls upon Jews everywhere to work personally for:

  • The unity of the Jewish people and the centrality of Israel in Jewish life;
  • The ingathering of the Jewish people in its historic homeland through aliyah from all countries;
  • The strengthening and support of the State of Israel, including advocacy on its behalf;
  • The active engagement of Jews in Israel and throughout the Diaspora in shaping Israel as an exemplary society (chevrah l'mofet) based on the prophetic vision of justice and peace;
  • The forging of a Jewish national culture anchored in Jewish heritage with Israel at its center;
  • The preservation of Jewish identity through the fostering of Jewish and Hebrew education and of Jewish spiritual and cultural values;
  • The protection of Jewish rights everywhere and the purging of anti-Semitism and the derogation of Zionism.

The aims of Zionism as defined by the 27th Zionist Congress in the 1968 Jerusalem Programme are:

  • The unity of the Jewish people and the centrality of Israel in Jewish life;
  • The ingathering of the Jewish people in its historic homeland Eretz Israel through Aliyah from all countries;
  • The strengthening of the State of Israel which is based on the prophetic vision of justice and peace;
  • The preservation of identity of the Jewish people through the fostering of Jewish, Hebrew and Zionist education and of Jewish spiritual and cultural values;
